Welcome to ESKAY PHARMACY. This website and all associated export services are owned and operated by ESKAY ALLIED PVT LTD. By accessing our platform or clicking “Place Order,” you entering into a binding legal contract and agree to be bound by the following terms.

1. Age Declaration and Legal Eligibility

By using this service, you provide a binding confirmation that you are at least 18 years of age. You acknowledge that the sale of pharmaceutical products is strictly regulated and that by placing an order, you are legally representing yourself as an adult. You further agree that you are ordering these products for personal, non-commercial use only and are legally capable of entering into a binding contract under the laws of India and your destination country.

2. Prescription and Safety Compliance

As a licensed pharmacy, we operate with a “Safety-First” approach. All prescription-only medicines require a valid, signed prescription from a licensed medical practitioner. ESKAY PHARMACY reserves the absolute right to verify the authenticity of any medical document. Any attempt to provide fraudulent information will result in the immediate cancellation of the order. We assume no liability for the misuse of medication or for any false health information provided by the customer.

3. Order Execution and Dispatch

An order is only considered legally confirmed after it has been reviewed and accepted by our professional pharmacists. We reserve the right to refuse or modify any order for reasons including, but not limited to, unverifiable prescriptions or international regulatory concerns. Once our pharmacy confirms the order and hands it over to our international logistics partners (the “Dispatch Event”), the sale is considered executed in full.

4. Strict Refund, Return, and Cancellation Policy

Due to international pharmaceutical safety protocols, ESKAY PHARMACY maintains a strict No-Return and No-Refund Policy once an order has been dispatched. Pharmaceutical goods require a verified “Chain of Custody” to ensure they are untampered and stored correctly. Once a parcel leaves our facility, the chain of custody is broken; therefore, we cannot accept returns or offer cash refunds.

  • Cancellations: These are only permitted before the order has been dispatched.

  • Reshipment Only: In cases where a parcel is damaged in transit or a pharmacy error is proven via a Mandatory Unboxing Video (see Section 5), our sole resolution is a reshipment of the goods. No cash refunds will be issued post-dispatch.

5. Mandatory Unboxing Video for Claims

To protect against fraudulent claims and transit damage, every customer is required to record a continuous unboxing video starting from before the parcel is opened. The video must show the shipping label clearly and remain unedited throughout the opening and inspection process. Without this video evidence, ESKAY PHARMACY will not enter into any claim for damage or error. If you open the parcel without recording, you waive your right to a replacement.

6. Customs and International Importer Responsibility

You are the “Importer of Record” for your shipment. It is your sole responsibility to ensure that the medication is legal for import into your country. ESKAY PHARMACY is not responsible for, and will not refund/resend orders that are seized, destroyed, or delayed by your local Customs authorities.

7. Limitation of Liability and Governing Law

ESKAY ALLIED PVT LTD and ESKAY PHARMACY provide products on an “as-is” basis and are not liable for adverse reactions, misuse, or transit delays beyond our control (Force Majeure). This agreement is governed exclusively by the laws of India. Any and all disputes shall be subject to the exclusive jurisdiction of the courts in Delhi, India.


Global Privacy & Data Protection

At ESKAY PHARMACY, we respect your medical privacy and comply with international standards such as GDPR, CCPA, and India’s DPDP Act. We collect your personal data—including name, address, and prescription details—solely to fulfill your order and satisfy legal export requirements. By placing an order, you provide informed consent for us to transfer your data across borders to international couriers and customs authorities.

We use secure, 256-bit encryption to protect your records; however, you acknowledge that international data transmission carries inherent risks. Under the Indian Drugs and Cosmetics Act, we are legally required to retain your medical and transaction records for a period of 3 to 5 years. We cannot delete these records until the statutory timeframe has passed. We do not sell your data to third-party marketers and only use it to ensure your medicine reaches you safely.
